Consumer: A Consumer is defined as someone who visits the Local Reviews website or app, or utilizes one of our various widgets or tools on Local Reviews website or app, or someone who views or utilizes one our various Local Reviews or Local Messenger widgets on one of our client’s websites, and is not an active paying Client of Local Reviews.

Client: A Client is any person or business who actively pays Local Reviews to use one or more of their services.

Affiliate: An Affiliate is any person or business who signs up for the Local Reviews affiliate program, and then actively promotes Local Reviews services through an affiliate link in an effort to sign up new Clients to Local Reviews and earn a commission.

Site Content

Local Reviews does NOT currently accept businesses that sell or promote the following types of products or content:

• Adult products and entertainment (IE. Adult-based products, sex toys, adult magazines or videos, etc.)

• Strip clubs.

• Escort services.

Local Reviews is the sole judge as to whether a business is approved or rejected, regardless of what type of business it is, and has the right to reject or cancel any account at any time.

Also, in certain cases where a specific local market or industry contains an abnormally high amount of questionable companies, Local Reviews may, at its discretion, choose to work exclusively with a specific company or companies in these industries that they feel are trustworthy and reputable, provided that these companies strictly adhere to and maintain all Local Reviews standards and practices.

Rating & Review Ownership

As a Local Reviews client, you understand that one of primary services we provide is that of a review facilitator, and as such, all ratings and review requests we receive from your clients are immediately redirected to other third-party review websites, which are subject to those third-party’s terms of use policies.

Client Security

Local Reviews may provide various code that clients may embed on their own website. As a security precaution and safe business practice, we highly recommend commenting out or removing any Local Reviews code on checkout pages, or pages where customer information like credit cards or social security numbers are added (“Sensitive Information Pages”). As a general practice, you should not have any 3rd party code on Sensitive Information Pages. If you add the Local Reviews code to your Sensitive Information Pages, this will likely make you liable should any security issues arise.

Email Policy

While using our review collection services as a client, you agree to only use the Local Review email tool to send email review requests to existing customers or clients who have either consented to, or have requested to leave a review.

As a client of Local Reviews, you will be opted-in to receive email updates pertaining to your account and the various services we provide. You agree that any notices, agreements, disclosures or other communications that we send to you electronically will satisfy any legal communication requirements, including, but not limited to, that such communications be in writing. You may unsubscribe at any time by clicking on the “Modify your subscription” link at the bottom of any email sent. Opting-out of our emails could result in you being unaware of an important change to our services or your account, and that by opting-out you agree to waive any claims or damages experienced because of not receiving our emails.

While receiving an email review request as a consumer, depending on how our client’s setup their account, you may receive one or more review request emails either from Local Reviews on behalf of one of our clients, or directly from one of our clients using their own email services. Please note that these review request emails are only used to send you to a survey specifically regarding your purchase.

As a consumer, you may also choose to correspond to our clients via our Local Messenger service, which allows our clients to communicate with you through a variety of different mediums including email, text, webchat, and various social media messaging apps. Typically, these two-way conversations are initiated by you the consumer, and are terminated once your question or need has been addressed or met.

Term; Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be updated or terminated by Local Reviews without notice at any time, for any reason. If you are a client, you can terminate the terms by closing your account. The provisions relating to Copyrights, Email Policy, Trademark, Warranty Disclaimer, Participation Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Affiliates

If you participate as a Local Reviews Affiliate, you agree to be bound by this Terms of Use agreement. In addition, you agree to use any and all Local Reviews affiliate related banners and text links in an ethical manner. You also agree that any affiliate text link information will be written to match the content and purpose of our site, and that you will not misrepresent the company or its products, services, or offerings in any way. You understand that Local Reviews decides what is ethical and can at any time terminate your affiliate account if they feel that you are misrepresenting the company or unethically marketing your affiliate links. If Local Reviews terminates your account, you will not be paid for any outstanding commissions.

SMS Text Messaging and/or Whatsapp Messaging

Local Reviews provides SMS and/or MMS Text Messaging services that allow our clients to be able to collect ratings and reviews from their customers via text messaging, or opting in to different keywords.  Local Reviews also provides similar services via Whatsapp.

All of our clients will be utilizing the same rating and review service for SMS notifications and/or alerts.

Here is hypothetical example of Local Reviews client’s using the SMS Text Messaging or Whatsapp service:“Thank you for choosing [store name].  Please take 10 seconds to leave us a review via the link below [survey link].”

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive between 1-2 messages per purchase on average, depending on what type of feedback you want to leave. Message frequency and content may vary depending on which company you are reviewing. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Local Messenger also provides SMS Text Messaging services that allow our clients and their customers to be able to have a two-way conversation if they so choose. The same terms and conditions apply.
